Morning Agro provides access to the Morning Agro.com website features and other products and services to you when you visit or shop at Morning Agro.com, use Morning Agro products or services, use Morning Agro applications for mobile, or use software provided by Morning Agro in connection with any of the foregoing (collectively, " Morning Agro. Services"). Morning Agro provides the Morning Agro Services subject to the following conditions.

By using Morning Agro website, you, a registered or guest user in terms of the eligibility criteria set out herein (“User”) agree to these conditions. Please read them carefully as your continued usage of the Website, you signify your agreement to be bound by these Terms. If you do not want to be bound by the Terms, you must not subscribe to or use the Website or our services.

2. ELIGIBILITY

a) Use of the Website is available only to such persons who can legally contract under the Contract Act, 1872.

b) If you are a minor i.e. under the age of 18 years, you shall not register as a user of Morning Agro. com and shall not transact on or use the Website.

c) By accepting the Terms or using or transacting on the Website, the User irrevocably declares and undertakes that he/she is of legal age i.e. 18 years or older and capable of entering into a binding contract and such usage shall be deemed to form a contract between the Website and such User to the extent permissible under applicable laws.

d) The usage of the Services offered through the Website is only available if the address of the User to which the product(s) is/are to be delivered is within Dhaka City, Bangladesh. It is possible to receive Morning Agro service and products to other major cities in Bangladesh through courier service. For any courier service delivery Morning Agro shall not be liable for any product damage or missing.

3. ELECTRONIC COMMUNICATION 

When you use site Morning Agro.com, or any of our services or contact us via phone or email, you consent to receive communication from us. You authorise us to communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the website and/or your order placed on the Website.  Additionally, any disclosures posted on the site, or sent to you by email fulfill the legal obligation of communication made in writing.

4. COPYRIGHT 

All content included in or made available through Morning Agro, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, website is the property of Morning Agro or its content suppliers and protected by Bangladesh and international copyright laws. We offer a wide range of Morning Agro Services, and sometimes additional terms may apply.

5. TRADEMARKS 

In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Morning Agro Service are trademarks or trade dress of Morning Agro in Bangladesh and other countries.

6. REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You may post reviews, comments, photos, videos, and other content; as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights).

Morning Agro has the right but not the obligation to monitor and edit or remove any activity or content. Morning Agro takes no responsibility and assumes no liability for any content posted by you or any third party.

7. PRODUCT DESCRIPTIONS

Morning Agro attempts to be as accurate as possible. However, Morning Agro does not warrant that product descriptions or other content of Morning Agro product is accurate, complete, reliable, current, or error-free. If a product offered by Morning Agro itself is not as described, your sole remedy is to return it in unused condition.

8. PRICING

"List Price" or the suggested price displayed for products on Morning Agro represents the full retail price listed on the product itself , suggested by the of a product itself, on as provided by manufacturer or supplier or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The list price or suggested price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. We regularly check List Prices against prices recently found on Morning Agro and other retailers. Certain products may have a "Was Price" displayed, which is determined using recent price history of the product on Morning Agro. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

Despite our best efforts, a small number of the items in our catalog may be mispriced. If the MRP of an item sold by Morning Agro is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. And if the stated price on the product is lower than Morning Agro, we will, either refund the amount or replace the product according to your preference, when acknowledged.

2. যোগ্যতা

ক) ওয়েবসাইটটির ব্যবহার শুধুমাত্র সেই ব্যক্তিদের জন্য উপলব্ধ যারা চুক্তি আইন, 1872 এর অধীনে আইনত চুক্তি করতে পারেন।

খ) আপনি যদি নাবালক হন অর্থাৎ 18 বছরের কম বয়সী হন, তাহলে আপনি মর্নিং এগ্রোর ব্যবহারকারী হিসেবে নিবন্ধন করবেন না। com এবং ওয়েবসাইটে লেনদেন বা ব্যবহার করবে না।

গ) শর্তাদি স্বীকার করে বা ওয়েবসাইটে ব্যবহার বা লেনদেন করার মাধ্যমে, ব্যবহারকারী অপরিবর্তনীয়ভাবে ঘোষণা করেন এবং অঙ্গীকার করেন যে তিনি আইনি বয়সের অর্থাৎ 18 বছর বা তার বেশি বয়সী এবং একটি বাধ্যতামূলক চুক্তিতে প্রবেশ করতে সক্ষম এবং এই ধরনের ব্যবহার একটি গঠন হিসাবে বিবেচিত হবে প্রযোজ্য আইনের অধীনে অনুমোদিত পরিমাণে ওয়েবসাইট এবং এই জাতীয় ব্যবহারকারীর মধ্যে চুক্তি।

d) ওয়েবসাইটের মাধ্যমে প্রদত্ত পরিষেবার ব্যবহার শুধুমাত্র তখনই পাওয়া যায় যখন যে ব্যবহারকারীর কাছে পণ্য (গুলি) বিতরণ করা হবে তার ঠিকানা ঢাকা শহরের মধ্যে হয়। কুরিয়ার সার্ভিসের মাধ্যমে বাংলাদেশের অন্যান্য বড় শহরে মর্নিং এগ্রো সেবা এবং পণ্য গ্রহণ করা সম্ভব। কোনো কুরিয়ার সার্ভিস ডেলিভারির জন্য মর্নিং এগ্রো কোনো পণ্যের ক্ষতি বা হারিয়ে যাওয়ার জন্য দায়ী থাকবে না।

3. ইলেকট্রনিক যোগাযোগ

আপনি যখন Morning Agro.com সাইট ব্যবহার করেন বা আমাদের যেকোনো পরিষেবা ব্যবহার করেন বা ফোন বা ইমেলের মাধ্যমে আমাদের সাথে যোগাযোগ করেন, তখন আপনি আমাদের কাছ থেকে যোগাযোগ পেতে সম্মত হন। আপনি আমাদেরকে ই-মেইল, এসএমএস, ফোন কল বা ওয়েবসাইটে নোটিশ পোস্ট করে বা যোগাযোগের অন্য কোনো পদ্ধতির মাধ্যমে আপনার সাথে যোগাযোগ করার অনুমোদন দেন। চুক্তিভিত্তিক উদ্দেশ্যে, আপনি আমাদের কাছ থেকে যোগাযোগ (লেনদেনমূলক, প্রচারমূলক এবং/অথবা বাণিজ্যিক বার্তা সহ) পেতে সম্মতি দিচ্ছেন, আপনার ওয়েবসাইট ব্যবহার এবং/অথবা ওয়েবসাইটে দেওয়া আপনার অর্ডারের বিষয়ে। উপরন্তু, সাইটে পোস্ট করা কোনো প্রকাশ, বা ইমেলের মাধ্যমে আপনাকে পাঠানো লিখিতভাবে করা যোগাযোগের আইনি বাধ্যবাধকতা পূরণ করে।

মর্নিং এগ্রোর মাধ্যমে অন্তর্ভুক্ত বা উপলব্ধ করা সমস্ত বিষয়বস্তু যেমন টেক্সট, গ্রাফিক্স, লোগো, বোতাম আইকন, ছবি, অডিও ক্লিপ, ডিজিটাল ডাউনলোড, ডেটা সংকলন এবং সফ্টওয়্যার, ওয়েবসাইট মর্নিং এগ্রো বা এর সামগ্রী সরবরাহকারীদের সম্পত্তি এবং এর দ্বারা সুরক্ষিত বাংলাদেশ ও আন্তর্জাতিক কপিরাইট আইন। আমরা মর্নিং এগ্রো সার্ভিসের বিস্তৃত পরিসর অফার করি এবং কখনও কখনও অতিরিক্ত শর্তাবলী প্রযোজ্য হতে পারে।

5. ট্রেডমার্কস

এছাড়াও, গ্রাফিক্স, লোগো, পৃষ্ঠার শিরোনাম, বোতাম আইকন, স্ক্রিপ্ট এবং পরিষেবার নামগুলি অন্তর্ভুক্ত বা যেকোনো মর্নিং এগ্রো সার্ভিসের মাধ্যমে উপলব্ধ করা হয়েছে বাংলাদেশ এবং অন্যান্য দেশে মর্নিং এগ্রোর ট্রেডমার্ক বা ট্রেড ড্রেস।

6. পর্যালোচনা, মন্তব্য, যোগাযোগ, এবং অন্যান্য বিষয়বস্তু

আপনি পর্যালোচনা, মন্তব্য, ফটো, ভিডিও এবং অন্যান্য সামগ্রী পোস্ট করতে পারেন; যতক্ষণ না বিষয়বস্তু বেআইনি, অশ্লীল, হুমকি, মানহানিকর, গোপনীয়তার আক্রমণকারী, মেধা সম্পত্তি অধিকার (প্রচার অধিকার সহ) লঙ্ঘন না হয়।

মর্নিং এগ্রোর অধিকার আছে কিন্তু কোনো কার্যকলাপ বা বিষয়বস্তু নিরীক্ষণ ও সম্পাদনা বা অপসারণ করার বাধ্যবাধকতা নেই। মর্নিং এগ্রো আপনার বা কোনো তৃতীয় পক্ষের পোস্ট করা কোনো বিষয়বস্তুর জন্য কোনো দায়িত্ব নেয় না এবং কোনো দায়বদ্ধতা নেয় না।

7. পণ্যের বিবরণ

মর্নিং এগ্রো যথাসম্ভব নির্ভুল হওয়ার চেষ্টা করে। যাইহোক, মর্নিং এগ্রো নিশ্চিত করে না যে পণ্যের বিবরণ বা মর্নিং এগ্রো পণ্যের অন্যান্য বিষয়বস্তু সঠিক, সম্পূর্ণ, নির্ভরযোগ্য, বর্তমান বা ত্রুটি-মুক্ত। যদি মর্নিং এগ্রো নিজেই প্রদত্ত একটি পণ্য বর্ণনা অনুযায়ী না হয়, তাহলে আপনার একমাত্র প্রতিকার হল অব্যবহৃত অবস্থায় ফেরত দেওয়া।

8. মূল্য নির্ধারণ

"তালিকা মূল্য" বা মর্নিং এগ্রোতে পণ্যের জন্য প্রদর্শিত প্রস্তাবিত মূল্য পণ্যটিতে তালিকাভুক্ত সম্পূর্ণ খুচরা মূল্যের প্রতিনিধিত্ব করে, একটি পণ্যের দ্বারা প্রস্তাবিত, প্রস্তুতকারক বা সরবরাহকারীর দ্বারা প্রদত্ত বা আদর্শ শিল্প অনুশীলন অনুসারে অনুমান করা হয়; অথবা অন্য কোথাও দেওয়া তুলনামূলকভাবে বৈশিষ্ট্যযুক্ত আইটেমের জন্য আনুমানিক খুচরা মূল্য। তালিকা মূল্য বা প্রস্তাবিত মূল্য একটি তুলনামূলক মূল্য অনুমান এবং যে কোনো নির্দিষ্ট দিনে প্রতিটি এলাকায় বিদ্যমান মূল্য প্রতিনিধিত্ব করতে পারে বা নাও হতে পারে। আমরা নিয়মিতভাবে মর্নিং এগ্রো এবং অন্যান্য খুচরা বিক্রেতাদের কাছে পাওয়া দামের বিপরীতে তালিকার মূল্য পরীক্ষা করি । কিছু পণ্যের "মূল্য ছিল" প্রদর্শিত হতে পারে, যা মর্নিং এগ্রোতে পণ্যের সাম্প্রতিক মূল্যের ইতিহাস ব্যবহার করে নির্ধারিত হয়। ডেলিভারি খরচ ছাড়াও চার্জ করা হবে; এই ধরনের অতিরিক্ত চার্জ যেখানে প্রযোজ্য সেখানে স্পষ্টভাবে প্রদর্শিত হয় এবং 'মোট খরচ'-এর মধ্যে অন্তর্ভুক্ত করা হয়।
